The Associated was founded by Brian Butler in 1985. In 1988 ASK was
granted charitable status for education and research in kinesiology.
ASK was also registered as a company limited by guarantee and not having
a share capital i.e. non profit making. As part of this process a document
referred to by the charity commission as a Governing Document and by
Company Law the same document but called the articles of association
and memorandum, was set up.
Within this document reference is made to a member, a trustee and a
director. The three titles all relate to the same person i.e. a trustee
is also a director and a member. A member in this reference means they
are a member of the board of directors and not to be confused with being
a member of the association.
This governing document now needs to be addressed and reviewed to bring
the document in line with today’s standards and this will be on
a future trustee’s agenda.
The revised document will need to be approved by the Charity Commission.
Trustees comply with the rules and regulations as set out in this document
and trustees also comply with both Charity and Company Law. Also there
are several areas of ‘good practice’ recommended by the
charity commission which whilst not ‘law’ are expected to
be upheld by trustees to maintain professional standards and demonstrate
good practice
Information about the ASK Charity and the Trustees is registered, approved and copies held by Companies House and the Charity Commission.
Brian Butler and Stephanie Mills were 2 of the trustees up until the
time he retired in 2001. At this point Brian chose to entrust ASK to
a set of new trustees, namely Marie Cheshire (MC), Sally Prestwich (SP),
Trevor Gale (TG) and Greg Phitidis, making a total of 4.
In 2001 Marie chose to resign as trustee and become the administrator
for ASK because the workload was increasing due to the expansion of
the membership, particularly the Associate membership and the need to
set up systems for the efficient running of the association. It was
agreed by the trustees that she needed remuneration for this position.
It is Charity Law that trustees do not receive remuneration while holding
the position of a trustee.
When Greg resigned (due to family reasons) in 2003, Liz Sippy, Alan
Lam and Allison Prebble were invited to become trustees.
Therefore since 2001, Sally and Trevor were trustees and Marie has been
the administrator. Viv, Marie’s husband, shares the administrative
work load with Marie.
2002 Marie was appointed as secretary to ASK. Since 2003 Sally, Trevor,
Liz, Allison and Alan were trustees and Marie the administrator/secretary.
From May 2010 Sally, Liz, Allison and Alan are the trusteees and Marie
the administrator/secretary.
